TENDER NOTICE


Sub: Notice Inviting Tenders for Supply of Manpower for Events in Pragati Maidan,          New Delhi

Tenders are invited by India Trade Promotion Organisation, a Govt. of India Enterprise, from agencies/companies who are registered with the Government and having minimum experience of three years in the field, to provide manpower purely on temporary basis for the events to be held from November 2010 to October 2011 in Pragati Maidan, New Delhi.

Interested agencies/companies may send their tender in a sealed envelope and must be superscribed `Tender for Manpower Service` along with the proof of their experience and previously accomplished assignments and other relevant documents such as  PAN No., Work Contract Registration Certificate required under provisions of the Sales Tax on Work Contract Act, 1999, Service Tax Registration Certificate, latest Income Tax Clearance Certificate, Sales Tax/VAT Clearance Certificate and Balance Sheet of the last three years of their company or any other mandatory business registration certificates required under Govt. of NCT, Delhi and Local Administration such as MCD and NDMC, etc. which should reach latest by 15th October, 2010 to:

The tender shall be opened in the presence of bidders at 3.00 pm on 19th October, 2010.
       
ITPO reserves the right to accept or reject any or all tenders without assigning any reason.

Terms & Conditions

ITPO intends to empanel three agencies/companies to provide manpower in Pragati Maidan to fair organizers/ exhibitors during Fairs/Events, purely on temporary basis for short period.  The manpower may include Guides (both Boys and Girls Guides), Interpreters, Field Assistants, Attendants, Electricians, Plumbers, Drivers, helpers and labourers etc.

2. Most of the posts mentioned above are under the category of Group-D (Attendants, Electricians, plumbers, drivers etc.); for that we may keep the eligibility qualification as 10th Pass.  For all other categories the minimum qualification would be Bachelor’s Degree and preference will be given to those possessing knowledge of computer applications. Accordingly, the agency shall ensure the quality of the manpower.

3. That the man-power employed by the Agency may also be required to work on Saturdays, Sundays and Holidays, before and after normal working hours, depending on the requirement and exigencies of work. In the event of working beyond normal working hours the additional charges on pro-rata basis may be charged by the Agency.  

4. The Agency shall directly interact with event organizers/ exhibitors, etc. and ITPO will not be responsible for the acts of omission and commission by the agency. The Agency shall also undertake to comply with the provisions of the Acts or Statues applicable to the Agencies.

5. The Agency shall be responsible for compliance of the obligations under various statutes, namely minimum wages Acts, ESIC Acts and Workman Compensation Act or under any other statutory requirements as applicable from time to time in respect of the man-power deployed and also to present the supporting documents in this regard as and when required or asked for by ITPO or the event organisers.  

6. ITPO role in the arrangement shall be limited to only empanelling the agency to enable them to function during the period of agreement in exclusive manner.  It is clarified that the manpower agency remains the principal employer of the workmen/staff deployed by them in Pragati Maidan. That it is expressly understood and agreed to between the parties to this Agreement that the manpower deployed by the Agency shall be employees of the Agency for all intents and purposes and in no case there shall be a relationship of Employer and Employee between the ITPO and the said Manpower.

The Agency shall be solely responsible for the suitability, medical fitness and police verification of the character and antecedents of the manpower sponsored by it for deployment in the Pragati Maidan.  ITPO shall not be responsible for any act of indiscipline, any medical claim and compensation of any personnel employed through Agency.

7. The manpower so deployed shall remain under the control and supervision of the Agency. The Agency shall be liable for payment of their wages etc, and all other dues payable under various labour Regulations and other statutory provisions.

8. That the manpower employed by the Agency shall have no right/privilege, whatsoever, for any appointment in the ITPO in temporary/ adhoc / daily wages /regular capacity on the basis of their working in the Pragati Maidan.

9. That in case any person deployed by the agency does any act amounting to nuisance, misconduct, indisciplinary or any act unbecoming of the employee, the agency on its own or on the advice of ITPO shall immediately withdraw such person from the premises of the Pragati Maidan.

10. That the Agency shall indemnify and keep indemnified ITPO against all claims whatsoever arising out of or on account of the activities of the manpower agency, its employees, assign, representatives, etc. at the Pragati Maidan premises or elsewhere. ITPO also reserves the right to cancel the registration/empanelment of such agency and induct any other agency at any time.  

11. That the deduction of Income Tax from the bills of the Agency, as per rules, will be made at source under relevant section 194(c) of the Income Tax Act, 1961 and as applicable from time to time.  

12. That the three agencies which may be empanelled shall  pay one time Registration/Empanelment  Fee of Rs. 25,000/- each (non- refundable) by Demand   Draft in favour of ITPO, payable at New Delhi, before entering into the agreement.

13.ITPO reserves the right to terminate the contract/ cancel the registration, if it is proved that the services rendered by the agency were not satisfactory or any complaints received in this regard.

14. The agency shall not be permitted to withdraw their offers once bid is made and process of finalisations of tender starts.

15. In the event of any dispute arising out of or during the currency of the contract, the matter shall be referred to CMD, ITPO or his nominee to act as a sole arbitrator under Arbitration & Conciliation Act, 1996.  The decision of the Arbitrator shall be final and binding on both parties.

16. The matter will be subject exclusive jurisdiction of Courts in the National Capital Territory of Delhi.

17. ITPO shall provide suitable place for the selected agencies to operate for the scheduled events to be held in Pragati Maidan.
