1. The units should be serviced every quarter and details recorded  in the maintenance register.

2. The sufficient number of mechanics and helpers should be available at Pragati Maidan/Bhawan who shall be  available to the Engineer-in-Charge.

3. The maintenance staff should be  available on all  days including holidays throughout the year between 09.00AM to 06.00PM.  Ion case of any emergency /fault , they shall work beyond these timings on unscheduled calls.

4. The company shall also maintain a stock of original factory repair/new compressors of each make of AC units for immediate replacement in the vent of compressor failure in any machine.  The  defective compressor shall be duly got  repaired only from the original company/manufacturer’s  respective maked of authorized  service center  of  AC machine.  Requisite records  shall be produced by the firm to the Engineer-in-Charge showing availability of new/original factory repaired  compressors/getting repaired subsequently as and when required.  Repairing of compressors locally other than factory/authoriesed service centers shall invite penal recoveries besides  contract being liable to be rescinded.

5. A record of the machines shall be  kept by the company including complaints attended  on the printed register  in which printed copies of gate passes/challans/repair details etc. of machine shall be maintained.

6. The contract amount shall  include all costs towards, transportation, repairs/maintenance/labour charges etc. nothing etc. shall be payable.

7. In event of shifting of machine form one place to  other, transfer shall be arranged  by the contractor,   the department is not  equipped with such man power.

8. The  machine with defective compressor should not  remain out of order for more than 3 days.  Complaints of other nature should be rectified the same day otherwise  a penalty of Rs.100.00 per machine  per day, shall be levied  from the  date of occurrence of the fault and this amount  should be  recovered from the dues of the contractor subject to maximum  amount of Rs.7,000/- per machine.

9. The staff  on duty shall report daily at 09.00AM to Engineering-in-Charge  or his authorized  representative.  The staff can be called  earlier on some situations.  Nothing  extra shall be paid by the department on this account.

10. The AC units are to be cleaned periodically including cleaning  of out side chassis, filters regularly.  Any area rusted on the chassis should be painted to avoid  further rusting with the matching colour  and approved shade  as and when require, No extra payment will be made on this account.

11. The ITPO will not be  responsible for any financial or any other liability in case of injury  or major/minor accident with the companies staff deputed  for the work under this contract.

12. The company shall make  a minimum stock of (5% of the total machines) spare part required  for day to day maintenance such as relay, thermostat switch, selector switch over load protector, condenser, filters etc.

13. The necessary tools and plants  such as welding set, gas charging equipment, pressure [pumps, blower etc. shall   also be readily available at site with company machines and staff.   Such  units may also be kept   at Pragati Maidan office.

14. Contractor shall indicate specifically in the office the details of original/factory repaired compressors available with them, ready on stock along with details of available man power, tools and plants, repair workshops facility etc. to establish their credentials to under take their contract and enclose with their tender documents.

15. The firms shall submit proof of possession of new/original factory repaired compressors for 1.5TR Fedders Lloyds,  Arco, Carrier, Blue Star, Videocon, Voltas make window type/split type AC units.

16. The electricity  and water supply will be provided by the department free of cost for testing, servicing & minor repairs etc.

17. Servicing space will be provided by the department free of cost.

18. The prospective  tenderer will have to deposit a Bank Guarantee of Rs.1.00 lakh before the award of work.  This bank guarantee shall be kept as a deposit with department as security of ITPO property refundable after satisfactorily handed over of the machines.

19. The contractor shall submit relevant challans for collection of machines and delivery of machines (after  carrying out the repair) at the time of submission of bills quarterly for payment.

20. A proper attendance register will be maintained by the firm to be daily countersigned by the Engineer-in-charge of his authorized representative.

21. The contractor shall also maintain a permanent record of movement of machines and up to date the same from time to time in the register maintained  for the purpose as per directions of the of  Engineer-in-Charge.

22. The movement of men and materials in Pragati Maidan complex etc.  is restricted.   The contractor will have  to intimate the name of their workmen, supervisory staff, engineer, proprietor etc. for getting their entry passes issued from the Chief Security Officer, ITPO.  Similar action will apply for contractor’s vehicle etc.  All such details will be submitted immediately after award of work.

23. No machine will be taken out of Pragati Maidan/Asian Games Village for repairs without written confirmation from the Engineer-in-Charge or authorized representative.  Same will apply for compressor repairs of the machines.

24. The contractor will provide service  machines immediately  in case of any break down in window type AC units till the defective machine is commissioned and installed.

25. The general terms and conditions as contained in CPWD from 7/8 Booklet may also be read along with these conditions.

26. The payment will  be  made  on prorate  basis  of  these  machine  which have  expired  the    guarantee  period.

ADDITIONAL CONDITIONS

1. CONTRACTOR will have to make his own arrangements for tools & plants required for the work.  The department will not supply any tools and plants unless otherwise specified.
2. The contractor must see the  proposed site for the work and study specifications and conditions carefully before tendering.  No claim of any sort shall be entertained on account of  any site conditions of ignorance of specifications.
3. The site is available,  tenderer should see the approaches and conditions of the site.  In case any approaches for main road is required at site or  existing approach is to be improved and maintained for cartage of materials by the contractors  the same shall be provided, improved and maintained by the contractor for stacking materials erection of Godwn, site office erection of his plant and machinery etc. at his own cost.  The contractor  should plan the procurement of materials  according to the space available.  No claim on account of cost of such works shall be entertained by ITPO.
4. The contractor will have to work according to progress of work  decided by the Engineer-in-charge.  No claim what-so-ever will be entertained on his account.
5. The contractor shall consult the Executive/Engineer-in-charge in writing regarding collection and stacking of materials in any place other than those approved by the Engineer-in-charge.  No excavated earth or building materials shall  be stacked on areas for which permission  of Engineer-in-charge has not been taken.
6. The contractor must take all precautions to avoid all accidents by exhibiting day and night  necessary  caution boards, speed limit boards, red flags and red lights and providing barriers.  He shall be responsible for all damages and accidents caused due to the negligence on his part.  No hindrance shall be caused to Traffic during execution of work.
7. Any damage done by the contractor or his workmen to any existing work during the course of execution of the work, tendered for shall be made good by him at his own cost.
8. The contractor shall maintain in good condition all work executed till the completion of the entire work allotted to the contractor  and handing over of the same to ITPO.
9. No compensation shall be payable to the contractor for any damage caused by rains windstorm or floods during execution of work.   He will make good all such damages at his own  and no claim on this account will be entertained.  The contractor shall bail cut rain water collected during execution of the work from the excavated trenches at his own cost.  Nothing extra will be payable on this account.
10. Contractor shall clear the site thoroughly of all rubbish etc. left out of his material immediately on completion of the work and properly clean and site around the building to the satisfaction of the Engineer-in-charge otherwise the site will be cleared by the department at his risk and cost after giving him two days notice if the fails to remove and clean the site.
11. The  work shall be carried out in a manner complying in all respect with requirement of relevant by law & law of NDMC/MCD.
12. At least one authorized representative should always be available  at site of work to take instructions from departmental officers and ensured proper execution of work.  This will apply specially for works exceeding more than  one lakh.
13. The contractor shall have to work as per programme of the department. No claim what-so-ever will be entertained on this account.
14. The  classification bricks  brought by the contractor shall strictly confirm to the printed CPWD specifications as applicable to ITPO also irrespective of the classifications shown on the  permit if there is a permit under which the contractor  might  have obtained the materials.  The contractor shall have no claim as to the quality of bricks on the basis of permit issued to him by the supply department.
15. If  the tenderer withdraws his option before award of the work or make any modification in the conditions of the tender which are not acceptable to the India Trade Promotion Organization shall without prejudice to any other right, or remedy, be at liberty to forfeit 50% of the s aid earnest money absolutely.
16. The contractor to whom the work is awarded will have to sign a separate agreement papers and the cost of such stamp paper will be formed by the contract.
