CORRIGENDUM
Subject: Amendments/Additions in the Tender Documents dated
17/12/2010 regarding allotment of F&B Outlet Nos. 6, 7, 8, 9, 11
and Jhatpat.
Reference Tender Notice dated 17/12/2010 published in the “Hindustan Times” and the “Hindustan”, the following amendments/ additions are made in the Tender Documents dated 17/12/2010:-

Not more than two F&B Outlets will be allotted to any applicant and /or his/her/their partners, associates, sister concerns etc. In case more than one F&B outlets are taken by any party by furnishing wrong information, their allotment of F&B outlets shall be cancelled forthwith without any refund of licence fee, security deposits and conservancy charges. |

Those F&B operators who have already operated / have been operating any F&B outlet in Pragati Maidan and not honoured the terms & conditions of the license Agreements and/ or are in litigation with ITPO in any legal fora for any reasons whatsoever during their F&B operations in Pragati Maidan, are not eligible to participate in the tenders. |

For violation of any terms & conditions, the defaulter licensee will also be debarred for allotment of any F&B outlet in Pragati Maidan in their name or in the names of their Partners, Directors, Associates, subsidiaries, sister concerns etc.etc. |
For violation of any terms & conditions of Agreement, the defaulter licensee will also be debarred for allotment of any F&B outlet in Pragati Maidan in his/ her / their name(s) or in the names of their Relatives, Partners, Directors, Associates, subsidiaries, sister concerns etc.etc. as defined in the Companies Act 1956 and / or in other applicable Acts. |
Addition - in Licence Agreement
Clause B.4 (Terms of Licence)
In case if for any reason whatsoever the Licensee continues to occupy the Licensed Premises beyond the expiry of Agreement, damages @ 5 (five) times of the licence fee for the first seven days of default, 10 (ten) times for the next seven days of default, of the licence fee (to be calculated on pro rata basis of licence fee quoted for the duration of licence) will be payable under this Agreement by way of liquidated damages. The Licensee agrees that it is a reasonable estimate of the damage and the licensee agrees to pay the same without any protest/demur. Under no circumstances will the licensee be allowed to occupy the F&B outlet after the fourteen days of default and the same would be taken over by the licensor without any notice and in such a situation, the licensee will have no right to their items, if any, found in the outlet and the same will be disposed off at the cost and risk of the licensee.
